Plymouth Comedy Festival - Terms and Conditions of Ticket Purchase and Entry

Version: 1.0 Effective date: September 2026 1. About these Terms 1.1 These Terms and Conditions (“Terms”) apply to every ticket, pass or other admission product purchased for Plymouth Comedy Festival and to every person attending an event forming part of Plymouth Comedy Festival (“Festival Event”). 1.2 Plymouth Comedy Festival (“the Festival”) is produced and promoted by Gelos Network Limited, a company registered in England and Wales under company number 15714647, whose registered office is at 30 Fore Street, Totnes, Devon, TQ9 5RP (“we”, “us” or “our”). 1.3 Plymouth Comedy Festival is a multi-venue festival comprising numerous independently scheduled performances, shows, workshops, talks, competitions and other activities taking place across Plymouth. Unless expressly stated otherwise, each separately ticketed Festival Event is a separate event for the purposes of your ticket and these Terms. 1.4 Tickets may be sold through Ticket Cove or another authorised ticket agent. The ticket agent may have separate platform terms and a privacy notice. These Terms govern the contract between you and us in relation to the Festival Event itself. Nothing in these Terms excludes or restricts rights which cannot lawfully be excluded. 1.5 By placing an order, you confirm that you are legally capable of entering into a contract and accept these Terms for yourself and every person for whom you purchase a ticket. You are responsible for making your party aware of relevant admission, age, conduct, recording and safety requirements. 1.6 The Festival Event listing, order confirmation and any expressly stated event-specific or venue-specific conditions form part of the contract. Where an event-specific condition directly conflicts with these Terms, the event-specific condition will apply to the extent of that conflict. 2. Ordering and Your Contract 2.1 An order constitutes an offer to purchase the selected ticket or tickets. A binding contract is formed when payment has been authorised and an order confirmation has been issued, subject to any obvious pricing, availability or technical error. 2.2 You are responsible for checking before purchase that you have selected the correct Festival Event, venue, date, time, ticket type and quantity and that the customer details supplied are correct. 2.3 Because Plymouth Comedy Festival contains numerous events, potentially taking place simultaneously or in close succession across different venues, you are responsible for ensuring that the Festival Events you purchase tickets for do not clash and that you allow sufficient time to travel between venues. 2.4 We are not required to refund or exchange tickets because you have purchased tickets for overlapping Festival Events, have insufficient time to travel between venues, attend the wrong venue or room, or otherwise make an error when planning your Festival schedule. 2.5 Tickets remain subject to stated capacity, sales limits and eligibility requirements. We may cancel tickets obtained through fraud, unauthorised automated purchasing, circumvention of ticket limits, misuse of discount or access codes, or an obvious pricing or technical error. Where you acted honestly and reasonably, sums paid for tickets cancelled by us under this clause will be refunded. 2.6 Each ticket permits one admission to the Festival Event specified on that ticket, subject to these Terms. A ticket that has been copied, altered, cancelled, refunded or already scanned is invalid. Where duplicate tickets are presented, only the first valid scan will be admitted. 2.7 A ticket for one Festival Event does not provide admission to any other Festival Event, venue or performance unless expressly stated otherwise. 3. Prices and Fees 3.1 The total price payable, including any mandatory booking or transaction fees, will be displayed before the order is placed. Optional charges will be identified separately. 3.2 Except where these Terms or applicable law require otherwise, booking fees, transaction fees, delivery charges and other charges are non-refundable once the relevant ticketing or delivery service has been supplied. 3.3 We are not responsible for fees or exchange-rate charges independently imposed by your bank, card issuer or payment provider. 4. No General Cooling-Off Right 4.1 Tickets for leisure events taking place on a specified date or during a specified period do not normally carry the statutory 14-day cancellation right applicable to some online purchases. 4.2 Subject to these Terms and your statutory rights, tickets cannot be returned, exchanged or refunded because you no longer wish or are unable to attend. 4.3 This includes illness, transport disruption, adverse weather affecting your journey, work commitments, mistaken purchases, personal circumstances, failure to arrive on time, inability to find parking, purchasing conflicting Festival Events or failing to allow sufficient time to move between Festival venues. 5. Transfers and Resale 5.1 Unless expressly stated that a ticket is personalised or non-transferable, you may give or sell your ticket to another person for no more than the total amount originally paid for it. The recipient will be bound by these Terms. 5.2 Tickets must not be resold for profit, in the course of a ticket-resale business, as part of an unauthorised commercial promotion or competition, bundled with other goods or services for commercial gain, or otherwise resold contrary to applicable law. 5.3 We may cancel a transferred or resold ticket where these restrictions have been breached and cancellation is lawful and proportionate. 5.4 Any refund due will normally be made to the original purchaser using the original payment method. 6. Festival Programme, Performers and Changes 6.1 Plymouth Comedy Festival comprises a programme of separate Festival Events taking place across multiple venues. 6.2 Festival programmes, performers, line-ups, hosts, support acts, running orders, billing, anticipated set lengths, venues, rooms and timings are subject to change. 6.3 Where a Festival Event is advertised as a mixed-bill, compilation, showcase, competition or similar multi-performer event, the inclusion of a performer's name in its title, description, artwork, programme or advertising does not guarantee that performer's appearance. 6.4 Line-ups for mixed-bill Festival Events are subject to change without penalty or refund. We may substitute, add, remove or reorder performers, including a named or headline performer, because of illness, emergency, travel disruption, professional commitments or other operational or unforeseen circumstances. 6.5 The withdrawal, substitution or addition of one or more performers from a mixed-bill Festival Event will not by itself constitute cancellation, rescheduling or a material change to that Festival Event. 6.6 Where a Festival Event is expressly advertised and sold as a solo show, tour show or performance centred upon one specified artist, we will deal with cancellation or a material change to that performance in accordance with clause 8 and applicable consumer law. 6.7 We may make reasonable changes to advertised start times, running times, content, format, rooms, venues or seating arrangements where necessary for operational, production, accessibility or safety reasons. 6.8 Where practicable, we will use reasonable efforts to notify ticket holders of significant changes using the contact details supplied with their booking. 6.9 The cancellation, rescheduling, relocation or alteration of one or more Festival Events does not constitute cancellation, rescheduling or alteration of Plymouth Comedy Festival as a whole. Any refund entitlement will ordinarily relate only to the affected ticket or Festival Event. 6.10 Advertised Festival programmes and schedules are subject to change. Printed programmes, posters, flyers and other physical materials may have been produced before subsequent programme changes. Customers should check the Festival website and relevant communications for the latest information. 6.11 Advertised end times are estimates and are not guaranteed. 6.12 Nothing in these Terms limits mandatory consumer rights where the essential nature of the service purchased is changed so substantially that it becomes fundamentally different from that purchased. 7. Venues, Rooms and Seating 7.1 Plymouth Comedy Festival takes place across multiple independently operated venues and spaces throughout Plymouth. 7.2 You are responsible for checking the venue and, where applicable, the specific room or performance space for each Festival Event before travelling. 7.3 Unless the Festival Event listing expressly allocates a specific seat, admission is unreserved and seating is available on a first-come, first-served basis. 7.4 Purchasing tickets together does not guarantee that a group will be able to sit together. 7.5 Sightlines, seating types, facilities, accessibility, temperature and other physical characteristics vary between Festival venues and spaces. 7.6 Some Festival Events may take place in temporary, pop-up, heritage, unconventional or non-theatre spaces. Customers should consider any venue information supplied before attending. 7.7 We may relocate a Festival Event to another room within the same venue, or where reasonably necessary to another reasonably suitable Festival venue, for operational, capacity, production, accessibility or safety reasons. 7.8 A reserved-seat ticket entitles the holder to the seat shown, but we or the venue may relocate the holder to a reasonably comparable seat where necessary. Where no reasonably comparable seat is available, an appropriate remedy may include a price adjustment, transfer or refund. 8. Cancellation and Rescheduling 8.1 If we cancel a Festival Event and do not reschedule it, the original purchaser will be entitled to a refund of the ticket price and any mandatory booking or transaction fees paid to us or collected on our behalf for that ticket, subject to applicable law. 8.2 Cancellation of an individual Festival Event does not entitle you to a refund for tickets purchased for other Festival Events which continue as advertised. 8.3 If a Festival Event is rescheduled, tickets will normally remain valid for the replacement performance. We will notify the original purchaser and provide a reasonable opportunity to request a refund if they do not wish or are unable to attend the replacement date. 8.4 If a Festival Event is relocated to a materially different venue and the change materially affects the service purchased, we will provide an appropriate remedy in accordance with applicable law. 8.5 A Festival Event is not considered rescheduled merely because its advertised start time changes by a reasonable period, its running time changes, its running order changes or, in the case of a mixed-bill event, its performers change. 8.6 Refunds will normally be returned to the original payment method. We may require reasonable evidence of purchase. 8.7 Except where liability cannot lawfully be excluded, we are not responsible for travel, accommodation, parking, childcare, subsistence, loss of earnings or other indirect or consequential expenditure incurred because a Festival Event is cancelled, rescheduled, relocated or changed. 9. Circumstances Outside Our Reasonable Control 9.1 We will not be in breach of contract or liable for delay, alteration or failure caused by circumstances outside our reasonable control. 9.2 Such circumstances may include severe weather, flooding, fire, epidemic or pandemic, government action, national mourning, industrial disputes, venue unavailability, utility or telecommunications failure, transport disruption, civil disorder, terrorism, security threats, performer illness or emergency, or supplier failure despite reasonable precautions. 9.3 Where circumstances outside our reasonable control make a Festival Event unsafe, unlawful or impracticable, we may suspend, curtail, relocate, reschedule or cancel it. 9.4 Any applicable refund entitlement will be determined under clause 8 and applicable law. Nothing in this clause permits us to retain payment where the law requires a refund for a service which has not been supplied. 10. Age Restrictions and Identification 10.1 Age restrictions may vary between Festival Events and venues. The restriction displayed on the individual Festival Event listing applies. 10.2 It is the purchaser's responsibility to check the applicable age restriction before purchasing tickets. 10.3 Where an Event has a minimum age requirement, we or the venue may require valid original photographic identification and may refuse admission where age cannot reasonably be verified. 10.4 Some performances may contain strong language, adult themes or material unsuitable for younger audiences even where younger attendees are permitted. Any specific content guidance supplied is advisory and cannot anticipate every element of a live comedy performance. 11. Accessibility 11.1 Accessibility varies between Festival venues, rooms and temporary performance spaces. 11.2 Customers requiring reasonable adjustments or with specific access requirements should contact us or the relevant venue as early as reasonably possible. 11.3 We will consider requests in accordance with applicable equality law and work with participating venues where appropriate. 11.4 Assistance dogs are welcome subject to reasonable venue and safety arrangements. 12. Admission and Festival Capacity 12.1 Admission is subject to the lawful licensing conditions, policies and reasonable instructions of Plymouth Comedy Festival, participating venues and authorised security or event staff. 12.2 Possession of a valid ticket does not remove the requirement to comply with applicable age restrictions, security procedures or these Terms. 12.3 Security searches may be carried out as a condition of entry. Refusal to cooperate may result in refusal of admission without refund. 12.4 Prohibited items include illegal drugs, weapons, items reasonably considered dangerous, unauthorised professional recording equipment and anything prohibited by the applicable venue. 12.5 Re-entry is not guaranteed and is subject to the policy and capacity arrangements of the individual venue. 12.6 A ticket guarantees admission to the Festival Event specified, subject to these Terms, but does not guarantee admission after the advertised performance has begun. 13. Arrival, Queuing and Latecomers 13.1 Customers are responsible for allowing sufficient time for travel, parking, walking between Festival venues, queues, ticket checks, security procedures and seating. 13.2 Festival Events operate to a timetable and may need to begin promptly to accommodate subsequent performances. 13.3 Late admission is therefore not guaranteed. Latecomers may be required to wait for a suitable break in the performance, may be seated in an alternative location or may be refused admission. 13.4 Leaving during a performance may affect your ability to re-enter. 13.5 No refund is payable where admission or re-entry is refused because of lateness, subject to our legal obligations including reasonable adjustments. 13.6 Queues may form at popular Festival Events. Customers with unreserved tickets are encouraged to arrive in good time. Position in a queue does not guarantee a particular seat or location within an unreserved venue. 14. Conduct and Removal 14.1 Live comedy may contain strong language, adult themes, challenging subject matter, audience interaction and material which some people may find offensive. Subjective dissatisfaction with lawful performance content does not provide an entitlement to a refund. 14.2 Audience interaction may form part of a live comedy performance. However, performers and staff must not be subjected to threatening, abusive, discriminatory or persistently disruptive behaviour. 14.3 Customers must behave safely and respectfully and must not disrupt Festival Events, harass or threaten others, persistently heckle after being asked to stop, enter restricted areas, damage property, smoke or vape where prohibited, use or supply illegal drugs or disregard reasonable instructions. 14.4 We, participating venues or authorised staff may refuse admission or remove any person where reasonably necessary for safety, licensing, prevention of crime or disorder, protection of performers, staff or customers, or the proper enjoyment of a Festival Event. 14.5 This includes anyone who appears dangerously intoxicated or whose conduct is abusive, discriminatory, disruptive, threatening or unsafe. 14.6 No refund is payable where a person is reasonably refused admission or removed because they have breached these Terms or a lawful and reasonable venue requirement. 15. Alcohol 15.1 Alcohol may only be sold and consumed in accordance with licensing law and individual venue policies. 15.2 Participating venues may operate Challenge 25 or another age-verification policy and may refuse alcohol service. 15.3 Alcohol purchased at one Festival venue may not necessarily be taken into another venue or performance space. 15.4 Bringing your own alcohol into a Festival venue is prohibited unless expressly permitted by that venue. 16. Photography, Filming and Recording 16.1 Audience members must not photograph, film, livestream or make audio recordings of performances without express permission. 16.2 Mobile devices must be silenced and used in a manner which does not disturb performers or other audience members. 16.3 We may require unauthorised recording to stop and, where lawful, unauthorised material to be deleted. Serious or repeated breaches may result in removal without refund. 16.4 Plymouth Comedy Festival, participating venues, members of the media and authorised contractors may photograph, film or record Festival activity for security, archival, editorial, press and promotional purposes. 16.5 Audience members may incidentally appear in photography or filming of Festival activity. Where an identifiable individual is the focus of promotional content, we will use an appropriate lawful basis and provide any notice or obtain any consent required by data-protection law. 16.6 Anyone with a particular concern about appearing in promotional recording should notify Festival or venue staff and reasonable steps will be taken where practicable. 17. Festival Passes, Packages and Promotional Tickets 17.1 Where Plymouth Comedy Festival offers passes, bundles, complimentary tickets, promotional tickets, discount codes or other special ticket products, additional conditions may apply and will be stated at the point of purchase or issue. 17.2 Unless expressly stated otherwise, possession of a Festival pass does not guarantee admission to a Festival Event which requires separate advance booking or reservation. 17.3 Complimentary, guest-list, promotional or competition tickets have no cash value and cannot be exchanged for money. 17.4 Discount codes cannot be retrospectively applied to completed purchases unless expressly agreed by us. 17.5 Misuse, duplication, resale or unauthorised distribution of promotional codes, complimentary tickets or passes may result in their cancellation. 18. Travel, Parking and Movement Between Venues 18.1 Plymouth Comedy Festival is a city-wide, multi-venue event. Festival venues may be separated by walking or travelling time. 18.2 Customers are responsible for planning their own journey between Festival Events and allowing sufficient time to reach each venue. 18.3 Any travel times, maps, directions or suggested routes supplied by us are for guidance only and cannot account for traffic, weather, accessibility requirements, queues or other delays. 18.4 We do not control transport, parking, accommodation or other independently supplied services and are not responsible for their availability, acts or omissions. 18.5 Missing a Festival Event because of traffic, parking difficulties, transport disruption or delays travelling from another Festival Event does not entitle you to a refund. 19. Personal Property and Liability 19.1 Customers are responsible for their belongings. Property is brought to Festival Events at the owner's risk and lost property will normally be handled under the applicable venue's policy. 19.2 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited. 19.3 Subject to clause 19.2, we are responsible for loss or damage which is a foreseeable result of our breach of contract or failure to use reasonable care and skill. 19.4 We are not responsible for loss or damage which was not foreseeable, was caused by your own breach or negligence, or relates to business use of a ticket purchased as a consumer. 20. Participating Venues and Third Parties 20.1 Plymouth Comedy Festival works with independently operated venues, performers, suppliers and other organisations. 20.2 Participating venues may impose their own reasonable admission, licensing, safety, accessibility and conduct requirements. 20.3 Where food, drink, accommodation, transport or another service is purchased directly from an independent third party, the contract for that service is between you and that third party unless expressly stated otherwise. 20.4 Nothing in this clause affects our responsibility for services which we have contracted to provide to you as part of your Festival ticket. 21. Complaints and Contact 21.1 Problems affecting your Festival experience should, where practicable, be raised promptly with Festival or venue staff so that there is a reasonable opportunity to address them. 21.2 Formal complaints or requests relating to tickets should be submitted using the contact details supplied on the Festival website, Festival Event listing or order confirmation. 21.3 Please provide your order number, Festival Event, purchaser name and a clear description of the issue. 21.4 Nothing in this clause limits your statutory rights or prevents you raising an issue later where it could not reasonably have been raised at the Festival. 22. Personal Information 22.1 Personal information will be handled in accordance with the applicable privacy notice. 22.2 We and our authorised ticketing provider may use information necessary to administer bookings, provide Festival Events, prevent fraud, protect customers and staff, comply with legal obligations and communicate essential information about purchased Festival Events. 22.3 Communications necessary to administer a ticket or inform you about a Festival Event you have purchased are service communications and are not marketing. 22.4 Marketing communications will only be sent where permitted by law and marketing preferences can be managed independently of your Festival booking. 23. General 23.1 If any provision of these Terms is found to be unlawful or unenforceable, it will be removed or limited only to the minimum extent necessary. The remaining provisions will continue in effect. 23.2 A delay in enforcing any right does not waive that right. 23.3 These Terms are between you and us. Except where the law provides otherwise, no other person has a right to enforce them under the Contracts (Rights of Third Parties) Act 1999. 23.4 We may update these Terms for future purchases. The version accepted when your contract was formed will apply to your order except where a change is required by law or expressly agreed with you. 24. Governing Law and Courts 24.1 These Terms and the contract between you and us are governed by the law of England and Wales. 24.2 If you live in England or Wales, the courts of England and Wales will have jurisdiction. 24.3 If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom in which you live. 24.4 Nothing in these Terms deprives you of mandatory consumer protections applicable to you.
